Terms & Conditions: The following terms and conditions (the “Voting Terms and Conditions”) govern the viewer voting program available for certain episodes of Love Island (the “Show”). Please note that the Voting Terms and Conditions are subject to change at the sole discretion of Got a Text, Inc. ("Producer") and NBCUniversal Media, LLC (“NBCU”).

1. Vote Description and Show App Voting Method

Vote Description:

During a Voting Window (as defined below), viewers of the Show will be asked to interact with the Show by voting on a variety of topics (the "Topic(s)") including, without limitation, which Islander(s) (as defined below) are their favorites, which couples of Islanders are their favorites, which Islanders they wish to keep on the Show, which Islander(s) to eliminate, and which Islander(s) will go on a date or get a reward. In the case of votes to keep Islander(s) on the Show or votes regarding favorite Islanders or favorite couples of Islanders, the Islander(s) or couple(s) of Islanders with the lowest number of votes may be eliminated from the Show. In the case of votes to eliminate Islander(s) from the Show and/or going on a date or getting rewards, the Islander(s) with the highest number of votes may be eliminated from the Show or get a date or a reward, as applicable. In each case, the voting format (e.g., elimination or another topic) and any specific terms relating to that particular vote will be announced during the applicable on-air description of the vote during the Show, on the Show’s official social media page(s), and/or within the Show’s official mobile application (the “Show App”) before the applicable Voting Window opens. Viewers will vote via the Show App on the applicable platform/devices as stated below. Producer and NBCU reserve the right to vary the format of any Voting Window, at their sole discretion. Producer and NBCU may allow Islanders to vote on various Topics, including Topics viewers may have already voted on, and may add restrictions to such Islanders' votes at its sole discretion. "Islanders" means for the purpose of these Voting Terms and Conditions, the participants appearing and competing on the Show.

Voting Method:

During the applicable Voting Window, viewers may submit votes via mobile application voting (the “Voting Method”). Users of Apple mobile devices with iOS for iPhones, iPad and iPad minis and users of mobile devices with Android may download the latest version of the Show App from the relevant app store. All users will be required to register their telephone number on the Show App before being able to vote and users should follow the in-app prompts to do so. Users may only register two (2) devices with the same number/account for voting. Show App users should follow the in-app instructions to vote during each Voting Window.

The Voting Method is open to viewers located in the fifty (50) United States and its territories and possessions, including the District of Columbia and Puerto Rico (collectively, the “Geographic Area”) who are eighteen (18) years of age or older. Information collected is subject to the ITV America Inc. Privacy Policy (located at https://www.itv-america.com/privacy-policy).

If there are technical or other issues with the Show App votes, Producer and NBCU reserve the right to discount the Show App votes (as applicable) in any manner and announce the result of the vote without including those affected votes.

There is a maximum of one (1) vote per user, per topic, per allowed device(s) (up to two [2] devices), per Voting Window. A Voting Window may include more than one (1) Topic for users to vote on. In the event Producer and NBCU discover users are voting in excess of the allowed limit, Producer and NBCU reserve the right to discount all or just those extra Show App votes (as applicable) and announce the result of the vote without including those affected votes and/or decide the outcome of the vote. Once a Voting Window concludes and results are tabulated, all or some portion of the results may be revealed during a subsequent exhibition of the Show, via the Show App and/or via the Show’s official social media page(s).

Producer and NBCU reserve the right to change the abovementioned limits on the number of votes that may be made via the Show App in Producer’s and/or NBCU’s sole discretion. The Administrators (as defined below) reserve the right, in their sole discretion, to reject votes cast by any individual who does not abide by the Voting Terms and Conditions or to take any other actions that they deem appropriate (including without limitation removing the Voting Method from the Show App altogether). Please note the Voting Method limits and restrictions may not be enforceable as written due to limitations on the Administrators’ ability to prevent and track Voting Method misuses, such as limitations on the ability to deduplicate votes submitted by one (1) user via more than two (2) registered devices.

2. Voting Windows

Voting by the Voting Method may be available during voting windows in connection with various Show episodes (“Voting Window(s)”). The Voting Window(s) shall be specified by Producer and/or NBCU via the Show, the Show App, and/or the Show’s official social media page(s). Each Voting Window will last approximately 2.5 hours as follows:

Voting Windows may be modified as determined and announced by Producer and/or NBCU in their sole and absolute discretion. Once the Voting Window closes all votes will be added and results tabulated. Producer and/or NBCU may at any time and in their sole discretion add or eliminate Voting Window(s) already announced or shift any Voting Window and post notice of such change or shift on the Show App, during the Show and/or via the Show’s official social media page(s). The Show's public distributions and exhibitions are subject to preemption and schedule changes. Please check Peacock’s schedule for the Show's distribution/exhibition dates/times. Voting results for all Voting Windows shall include all eligible votes received, except as set forth in these Voting Terms and Conditions.

Additional Voting Windows may be added as determined and announced by Producer and NBCU in their sole discretion.

3. Cost of Voting

There is no charge when voting via the Show App, however, App Voting is subject to standard Internet access charges and data rates may apply according to such user’s wireless carrier service agreement for Show App download and usage.

4. Disclaimers

NBCUniversal Media, LLC, Got a Text, Inc., Monterosa Productions Limited, Neo Studios and each of their respective direct or indirect parents, subsidiaries, related and affiliated entities and persons, and each of their respective agents, officers, directors, employees, managers, members, contractors, and their respective successors, licensees and assigns, and any other entity involved in the development, administration, promotion, or implementation of the Voting Method and these Voting Terms and Conditions (collectively, the “Administrators”) are not responsible for and shall not be liable for: lost, incomplete, late, damaged or misdirected votes; difficulties, failures or malfunctions of computers, phones (including wireless phones/handsets) tablets and/or other devices, phone lines or telephone systems or other communications malfunctions; difficulties, failures or malfunctions of cellular equipment towers, telephone systems or wireless services; interrupted or unavailable networks, applications or servers; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission, communication or report; traffic congestion or for any technical or other problem which may cause the voting to be disrupted or corrupted.

If for any reason the voting is not capable of being executed as planned, or if there is an infection by computer virus, bugs, tampering, unauthorized intervention, fraud, hacking or technical or reporting failures, or if any other causes beyond the control of Administrators corrupt or affect the administration, security, fairness, integrity, or proper conduct of this voting, the Administrators reserve the right, in their sole discretion, to take any action they deem appropriate or to withdraw the transmission of any vote, but are in no way obligated to do so. Furthermore, the Administrators may, but are not obligated to, permanently disqualify from any voting any person Administrators believe has intentionally violated these Voting Terms and Conditions, and terminate or suspend voting at any point and declare the vote results based on the votes up to that point or any vote-discounting procedure determined in Producer’s and NBCU’s sole and absolute discretion, if it appears that the voting process has been so distorted by hacking, failures, errors or other interference that the results would not reflect actual valid votes should the voting continue. In the event of technical or reporting difficulties with the Voting Method including, but not limited to, mobile or Internet service interruptions, Administrators, in their sole discretion, reserve the right to review the votes for accuracy and to take any action they deem appropriate, including, without limitation, voiding all votes cast during the time period in which such technical or reporting difficulties occurred, voiding the votes cast during the time period in which such technical or reporting difficulties occurred with such method, and/or removing the Voting Method from the Show altogether, but are in no way obligated to do so. In the event of technical or reporting difficulties with the Voting Method, or in the event two or more contestants receive the same number of votes such that the winner(s) or loser(s) of any vote cannot be determined, Administrators reserve the right to have eliminations be determined by any method determined by Producer and NBCU in their sole discretion. Administrators assume no responsibility for any injury or damage to participants or voters or to any person's computer or other property relating to or resulting from entering or downloading materials, applications or software in connection with the Show’s vote program, or otherwise participating in the Show’s voting program. Administrators are not responsible for telecommunications, network, electronic, technical or computer failures of any kind, for inaccurate transcription or reporting of voting information, errors in any promotional or marketing materials, for any human or electronic error, or for votes or reports that are stolen, misdirected, garbled, delayed by computer transmissions, lost, or late. By participating, each individual agrees to release and hold the Administrators harmless against any and all claims and liabilities of any kind arising in whole or in part, directly or indirectly, out of such individual’s participation in the voting program. Administrators will take commercially reasonable steps where practicable to prevent voting outside of the Geographic Area; however, some votes cast outside of the Geographic Area may be counted. Administrators will also take commercially reasonable steps where practicable to enforce the Voting Method limits and restrictions set forth in these Voting Terms and Conditions; however, some limits and restrictions may not be enforceable as written due to, among other things, limitations on the Administrators’ ability to prevent and track Voting Method misuse, such as voting using more than two (2) registered devices.

Producer and/or NBCU reserve the right, for any reason and in their sole discretion, to modify, suspend or discontinue the Show without prior notice.

These rules are subject to change at any time at the sole discretion of the Administrators. Notification regarding any such change will be posted on the Show App or by publishing an updated version of these Voting Terms and Conditions.

Caution: Any attempt by a voter or any other individual to deliberately damage any online service or website, tamper with the voting process, or otherwise undermine the legitimate operation of the voting is a violation of criminal and civil laws and should such an attempt be made, Administrators reserve the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law.

5. Conditions for Voting

By voting, you are agreeing not to use any unofficial, third-party services to cast votes on your behalf. Administrators reserve the right, but are not obligated, to disqualify, block or remove any votes from any individual who votes by any electronic, mechanical or automated means, or otherwise tampers with the vote process, or for any other reason, as determined by Administrators in their sole discretion.

Administrators are not responsible for any damages to voters' device(s) that may occur from use of any service. Administrators reserve the right, for any reason and in their sole discretion without any obligation, to modify, suspend or discontinue the voting service without prior notice.

Administrators reserve the right to modify any of the Show's contest or voting rules, the Voting Terms and Conditions, and the Voting Windows at any time in their sole discretion.

The Show incorporates a competition between the Islanders (the “Competition”). The Islanders are competing for a chance at a cash prize (the “Prize(s)”), and the Competition may be affected by the outcome of Show votes. Producer and/or NBCU may in their sole discretion eliminate an Islander for any reason and/or reintroduce an Islander seen in earlier stages of the Competition who was previously eliminated. All Producer and NBCU decisions in connection with the Show will be final. The Prize(s) and the impact of viewer voting, is subject to the terms, conditions, rules and qualifications of that program. For the avoidance of doubt, no Prize will be awarded to any voter. Votes will be solely used to assist in determining Show events and/or Competition-relevant outcomes as determined by Producer and/or NBCU in their sole discretion.

6. Dispute Resolution

THESE VOTING TERMS AND CONDITIONS, AND SUBMISSION OF YOUR VOTE, ARE GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY'S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
